ELIGIBILITY: The Giveaway is offered only to legal residents of the United States, who physically reside in the United States and who are at least 18 years old at the time of entry. Employees and directors of StyleFeeder, Inc. (the “Sponsor”) and its parent, affiliates and advertising and promotional agencies and each of their immediate family members or members of the same households are not eligible. By entering the Giveaway, you agree to these Official Rules and the decisions of the Sponsor or its designee, which are final and binding in all respects.
GIVEAWAY PERIOD: The Giveaway begins on November 3, 2008 at 12:01 AM ET and ends when Sponsor has registered a user whose StyleFeeder user number is greater than 1,000,000 and who registered as a result of being invited by a friend (through the method provided in the first paragraph of the “Entry” section below) (the “Giveaway End Date”).
ENTRY: To register for the Giveaway, please simply register for StyleFeeder at the StyleFeeder home page, which is located at www.stylefeeder.com, and create your own StyleFeed (if you don’t already have a StyleFeeder account). You then can invite friends and others in your address book(s) directly from your profile page (http://www.stylefeeder.com/myaccount-invites.html) – the more invites that you send, the better your chance of winning. The use of any automated entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly is prohibited. Such automatically generated entries will be discarded and may result in total and permanent disqualification from the Giveaway.
Alternatively, you may also register for the Giveaway by mailing to the Sponsor, postage pre-paid, a 4” x 6” card with the following information (the “Entry Card”): (i) your full name, (ii) your complete address, (iii) a valid email address for you, (iv) a valid telephone number for you and (v) the words, “the “Invite the Millionth User” Giveaway entry.” The Entry Card should be mailed to StyleFeeder “Invite the Millionth User” Giveaway, c/o StyleFeeder, Inc., 678 Massachusetts Avenue, 7th Floor, Cambridge, MA 02139. Only one entry per card.
DRAWING/PRIZE: A winner will be determined by the order of the entries received. Following the Giveaway End Date, Sponsor or its designee will determine, (i) using StyleFeeder site logs, which StyleFeeder user invited the newly registered user closest to and greater than 1,000,000 to join StyleFeeder and (ii) which Entry Cards actually received by Sponsor as of the 7th day after the Giveaway End Date were postmarked on the Giveaway End Date. The winner (the “Winner”) will be randomly chosen from such entries. In the event that more than one entrant could have invited the newly registered StyleFeeder user closest to and greater than 1,000,000 based on the seemingly simultaneous timing of entries, all such entrants will be included in the group of entries from which the winner will be randomly selected. Bluefly® will provide one (1) Grand Prize (the “Prize”) to the Winner: a $500 Bluefly.com Gift Certificate. The winner will be required to establish a Bluefly® account and comply with other Bluefly® terms and conditions in order to receive the Prize. The gift certificate will be awarded in the form of a credit to the Winner’s Bluefly® account. In order to redeem the $500 gift certificate, the Winner must have or create a Bluefly® account and have a valid credit card on file. Approximate Retail Value: $500. No substitution of the Prize by the Winner is permitted, and taxes are the sole responsibility of the Winner.
Winners will be notified by email on or about the day of selection. The Winner will be required to respond to the notification to acknowledge receipt of the Prize. If (i) no response is received from the Winner with all requested information within 7 business days from the notification attempt or (ii) the Winner is found to be ineligible or does not comply with these Official Rules, the Winner may be disqualified, and an alternate Winner may be selected. The Sponsor is not responsible for Winner notifications that are delayed, lost, misdirected, or misdelivered.
ODDS: Only one prize will be awarded. Odds of winning depend on the number of eligible invites and Entry Cards sent and the timing of invites and Entry Cards.
GENERAL CONDITIONS: Except where prohibited by law, entry and/or acceptance of the Prize constitutes permission for the Sponsor and its agents to use the Winner’s name, address, statements, biographical information, image, and/or likeness for advertising and trade purposes without further compensation in any and all forms of media including, without limitation, online.
The Sponsor reserves the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Giveaway or violates the Official Rules.
The Sponsor reserves the right to cancel, terminate, modify, or suspend this Giveaway at its discretion for any reason beyond its reasonable control including, but not limited to fraud and technical failures.
By participating in the Giveaway, entrants release the Sponsor and other entities associated with this Giveaway (including their parents, affiliates, subsidiaries, officers, directors, representatives, agents, and employees) from any and all liability for any claims, costs, losses, injuries or damages arising out of, resulting from or in connection with the Giveaway (including, but not limited to, (i) submission of any Giveaway entries, including misdirected, lost or incomplete entries, (ii) acceptance, possession, or use of the Prizes (including, but not limited to, claims, costs, losses, injuries or damages related to personal injuries, death, rights of publicity or privacy, defamation, or portrayal in a false light), (iii) participation in the Giveaway, or (iv) any technical malfunction of the telephone network, computer online system, computer time or date mechanism, computer equipment, hardware or software, program malfunctions or technical errors, or any combination thereof, or any lost, garbled, misdirected, illegible, or delayed data transmissions).
This Giveaway is governed by the laws of the United States and the Commonwealth of Massachusetts without regard to conflict of laws provisions thereof. Any dispute arising hereunder shall be subject to jurisdiction in the Commonwealth of Massachusetts, U.S.A. If any provision of these Official Rules is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. No waiver to these Official Rules will be effective unless in writing and signed by the party against which enforcement is sought.
To the maximum extent permitted by law, the Sponsor reserves the right to change these Official Rules at any time by posting an amendment on www.stylefeeder.com.
COPIES OF WINNERS’ NAMES: To receive a paper copy of the Winner’s name and Prize awarded, please send a self-addressed, stamped envelope to: Winner of the StyleFeeder “Invite the Millionth User” Giveaway, c/o StyleFeeder, Inc., 678 Massachusetts Avenue, 7th Floor, Cambridge, MA 02139. All requests for the names of the Winner and Prize awarded must be received by June 30, 2009.
